One look at the newspaper and the worst is confirmed. The Dubai Government has officially stated that it will not bail out DubaiWorld from a US$60 billion debt repayment schedule. This means that the ports and shipping related authority is left on its own to figure out how to restructure the debt repayments to the satisfaction of creditors and other concerned parties.
So what’s the worst that can happen? DubaiWorld could try to sell off its assets to raise money to pay off some of the debt, and even ask the creditors for a further moratorium on the balance to be repaid. At the worst if it is not successful, the company could go bankrupt. While this is not entirely unheard of in a recession, as has happened to the banking and mortgage companies in the USA, the problem here is that it would reflect badly on the DubaiGovernment. Eyebrows will undoubtedly be raised if it is allowed to happen. The truth is that the Dubai Government has stretched itself to the limit on the path of development and is hard pressed to come up with a workable solution.

So it is left to Dubai World alone to find a way out of its present predicament. Notwithstanding that it has been backed by the Government in the past, this time the DubaiGovernment refused to come to its aid. Whatever the outcome, the management of DubaiWorld will learn some very tough lessons as they pass through this ordeal. And so they should. Financial discipline, realistic estimates and a less luxurious lifestyle are some of the lessons to which its executives need to condition themselves.

To my mind, the market has over-reacted to this recent event. Dubai World has not in effect defaulted on the loan. Maybe its own staff or a group of experts such as Deloitte can work out something that will help Dubai World tide over the present time. Staff at this ports authority will need to work hard and make some sacrifices. Some heads might roll without a doubt. But in the end the company and Dubai would be saved.

The mismanagement, rather miscommunication of the whole issue has added to the worries of investors, and the Western media is having a field day fanning all sorts of rumors that Dubai could be the epicenter of another financial fiasco. With Dubai World losing the support of its Government, it was left to the corporate entity to respond and lift itself out of the abyss of rumor and conjecture. In fact it’s quite typical of the Arab world to have a laid back attitude and say ‘Inshallah’ rather than strive to work itself out of difficulty. To its credit, Dubai World has lost no time in doing so and called a panel of experts from Deloitte to assist. What ultimately transpired was that Dubai World will be asking for a restructuring of US$26 billion of debt largely pertaining to two of its subsidiaries-Limitless and Nakheel- at a creditors meeting scheduled for next week. The moratorium will be for six months.

You will be aware that regulations taking effect from the 1st July 2007 will mean that virtually all enclosed public places and workplaces in England will become smoke-free. The law
An enclosed vehicle and any enclosed part of a vehicle must be smoke-free if it is used:
1. by members of the public or a section of the public (whether or not for reward or hire)
2. in the course of paid or voluntary work by more than one person (even if those persons use the vehicle at different times, or only intermittently).
What this means is that most enclosed vehicles used by the public or for work purposes must be smoke free.
Convertibles
A vehicle with a detachable or stow-away roof is exempt provided that in its stowed away/detached form, it does not cover part of the vehicle. Therefore, a convertible vehicle will not have to be smoke free when the roof is fully retracted/removed.
Vehicles used by the public
The smoke-free regulations will apply to taxis, buses, trains. In some limited cases, this will apply to ships or hovercraft. Aircraft are already subject to legislative control. It would also appear that if a vehicle is used to give a client/customer a lift, then it would have to be smoke-free.
Vehicles used for work purposes
The regulations apply to an enclosed vehicle if it is used in the course of paid or voluntary work by more than one person (even if those persons use the vehicle at different times, or only intermittently). Two points to note here:
1. note that the determining factor is ‘use’, not ‘ownership’ – a privately owned vehicle used for work purposes would be required to be smoke free (subject to the exemption below)
2. also note that this applies to voluntary workers – ‘paid or unpaid’
The smoke-free regulations will therefore apply to pool cars, delivery lorries where there could be more than one driver or a driver’s mate, or a vehicle which has one primary driver but is occasionally used by others.
Exemption
A vehicle is not classed as being used in the course of paid/voluntary work where it is used primarily for the private purposes of the owner/person who has an unrestricted right to use it.
␣ Where the primary (unrestricted) use of the vehicle is for private purposes, it would be exempt. No definition of ‘primary’ – eg private v business mileage is a natural method of distinguishing.
␣ What is less clear is what happens when a vehicle is handed over to another employee for them to use permanently.
Compliance
Obligations are placed on the driver, a person with management responsibilities for the vehicle and any person on a vehicle who is responsible for order or safety on it, to ensure that the vehicle is smoke free.
The international smoke-free sign (70mm in diameter) must be displayed in every compartment of the vehicle.
Managers prosecuted for failing to prevent smoking in a smoke-free vehicle can avail themselves of a due diligence defence. As it is a legal requirement to display a no-smoking sticker, it is unlikely that a due diligence defence will succeed if based simply on a manager placing a sticker in a vehicle. Managers should consider updating fleet policies and sending to all drivers.
Care will also need to be taken in identifying those vehicles that must be smoke free. All ‘pool’ vehicles will need to be smoke free as it is anticipated that they are used primarily for work purposes. In cases of company cars where there is a primary user, but where other persons have access to the vehicle on occasions, consideration will have to be given to the overall use of the vehicle by reference to, for example, ‘business’ versus ‘private’ mileage. In light of the need to keep vehicles smoke-free if giving lifts to clients/customers, or where use by more than one person cannot be ruled out, managers may wish to consider adopting a ‘no smoking’ policy in relation to all vehicles used whilst on company business.
Penalties
␣ Failure to display a no smoking sign carries a maximum penalty of £1,000 on conviction or £200 fixed penalty (£150 if paid within 15 days).
␣ Smoking in a smoke free place carries a maximum penalty of £200 on conviction or £50 fixed penalty (£30 if paid within 15 days).
␣ Persons controlling or being concerned in the management of smoke vehicles and failing to stop a person smoking there carries a maximum penalty of £2,500 on conviction with no option of a fixed penalty.
Also note that
␣ Under the Environmental Protection Act 1990 it is already an offence if smokers litter the public highway (smoking materials and smoking waste) and they can be subject to a Fixed Penalty or risk prosecution. The Fixed Penalty will be £75 unless the Local Authority specifies a different amount.

With a place in the final already clinched and nothing much at stake, most of India's batsmen batted sloppily. However there was no such charity from Virat Kohli as he struck a mature unbeaten century to ensure that India went into Wednesday's game on the back of three successive wins.

Shakib Al Hasan's 85 and a 106-run partnership with the lively Mahmudullah had lifted Bangladesh from a dismal 95 for 5 to 247 for 6, but on a placid track and against a line-up in form, it was nowhere near enough. India cantered home with seven overs to spare.

Kohli played with commendable concentration until victory was in sight, driving and cutting beautifully even as wickets fell around him. He got his first reprieve on 83, when Mohammad Ashraful put him down at deep midwicket off Syed Rasel, and the butter-fingers epidemic appeared to catch on, with Mushfiqur Rahim fluffing a stumping off Shakib in the next over. Ashraful's woeful outing continued when he dropped Suresh Raina two balls later. It summed up Bangladesh's evening in the field though the match was as good as over by then.

The only interest towards the end of the game centred around whether Kohli would get to his second century. The first 50 had taken just 47 balls, and he was especially severe on Shafiul Islam in his final spell, off-driving and pulling with authority. Naeem Islam was punched off the back foot for four and when Rasel decided to test him with a short one, he pulled it behind square for four. Victory and three figures were completed in a hurry, with an off-drive and a leg-side swish off Shakib.

Bangladesh needed early wickets to send any tremors through the Indian ranks but they didn't get them. Naeem had contributed a brisk 22 late in the Bangladesh innings as they took 47 from the batting Powerplay and 95 from the final 10 overs to reach a respectable score. Shakib was dropped by Dhoni off Yuvraj when he had made just 38 and he took advantage with some punishing strokes in the final stages of the innings. There was some fortune, with a top edge clearing Dhoni for four, but there was also plenty of ability, with Sudeep Tyagi being pulled for two fours and then scooped impudently down to fine leg. But when he tried to repeat the stroke off Ashish Nehra's slower ball, he only found Dhoni's gloves.

Mahmudullah had started off with a thump over cover off Mishra, and he then lofted Nehra to long-off for four more. India had started much the better. After a maiden from Tyagi, Imrul Kayes had flailed twice through the off side as Sreesanth pitched too wide, but when he tried the same approach against Tyagi, Kohli snaffled him at point. Ashraful had no thoughts of consolidating - after playing one reckless shot to third man, he decided to give Sreesanth the charge and played on via the pads.

Raqibul Hasan played some chancy strokes, and a delightful pull off Tyagi, while Tamim Iqbal, after a cautious start, lofted Sreesanth over mid-on and then pulled him for four. Raqibul was then run out as Yuvraj managed to deflect a Shakib drive on the stumps, and though Shakib gave the fans something to cheer with some crisp strokes through the off side, Mushfiqur lobbed a slower one from Yuvraj straight to the man at cover to leave the side in disarray with half the overs remaining. Infosys Technologies has declared its third quarter results of FY10. It has posted 2.73% jump in its Q3 net profit of Rs 1,582 crore as against Rs 1,540 crore in previous quarter.

Revenues went up 2.8% at Rs 5,741 crore versus Rs 5,585 crore. Topline as well as bottomline were above the street estimates. CNBC-TV18 was expecting net profit of Rs 1,490.1 and revenues of Rs 5,596.8 crore.

“Global economic recovery seems to be led by the US and the Financial Services,” said S. Gopalakrishnan, CEO and Managing Director. “Even though IT budgets are expected to be flat in 2010, offshore outsourcing is expected to benefit EBIDTA (earning before interest, depreciation, tax and amortisation) margins increased to 35.49% versus 34.61% (QoQ).

"The contribution from top ten clients grew by 12.2% during the quarter. Our clients are taking decisions much faster," said S.D. Shibulal, Chief Operating Officer. "Our focus on New Engagement Models (NEMs) was strengthened by the launch of Flypp™, our latest technology platform for telecom service providers."

FY10 Guidance

In dollar terms, its Q4 revenues are likely to be at USD 1.24-1.25 billion and EPS at USD 0.56 per share. FY10 revenues are expecting to be at USD 4.75-4.76 billion and EPS at USD 2.26 per share.

In rupee terms, Infosys sees income for the FY10 at Rs 22,473-22,519 crore and EPS (earning per share) at Rs 106.85-107.06.

Two years after bringing in fresh recognition for hockey with his Bollywood blockbuster Chak De India, actor Shah Rukh Khan has now taken up the cause of the national hockey players amid a gripping payment crisis in the sport. In the city to oversee the ongoing camp of the Kolkata Knight Riders at the Calcutta Cricket & Football Club (CCFC), Shah Rukh today gave a strong statement in support of the national hockey players who are fighting a bitter battle against the national hockey federation for not getting pending payments.

“Hockey is very special and it’s our national sport. What has happened is really sad,” Shah Rukh told reporters here on the sidelines of the Knight Riders camp. The national players, who are in Pune for a camp, took to a strike protesting non-payment of dues, then brokered a temporary, and finally Asked if the national hockey should go ahead with the agitation, the Bollywood actor and co-owner of the IPL side Knight Riders said: “Everyone has to take a stand in the way they feel but I hope the issue gets resolved. It’s not nice that there is a strike and it’s not nice either if the players go out to play when they are actually unhappy and unattended to in some matters of economics. I hope it gets resolved soon. The focus should be on resolving the crisis and not highlighting it,” Shah Rukh said.

The popular actor pointed out that the ongoing dispute has come at the wrong time, with the World Cup round the corner.

Hockey India seems to have brokered some sort of peace when they met six of the senior Indian players, including captain Rajpal Singh, in New Delhi last Saturday, but talks fell through and the players resumed their strike starting today.

Last week, Shah Rukh created a flutter on Twitter when he posted a message backing the national players over the payment fracas.

‘Kolkata has been let down’

The Delhi High Court on Tuesday upheld its single bench order that the office of the Chief Justice of India (CJI) comes within the purview of the Right to Information (RTI) Act and details of judges assets should be revealed under that.

A bench comprising Chief Justice AP Shah and Justices S Muralidhar and Vikramjeet Sen said, "Higher the judiciary, higher is the accountability towards the public at large".

Emphasising the importance of RTI, the bench said, "RTI has over-reaching impact. Citizens who require such information should not misuse the information, thus saving the independence of (the) judiciary."
